General Terms and Conditions
1. Scope of Application
These General Terms and Conditions apply to all orders placed through the online shop of Gosner Trade SRL by consumers (B2C) and businesses (B2B) within the European Union.
Businesses within the meaning of these GTC are natural or legal persons or legal partnerships who, when concluding the contract, are acting in the exercise of their commercial or independent professional activity.

3. Conclusion of Contract
The presentation of products in the online shop does not constitute a legally binding offer, but rather a non-binding invitation to order.
By clicking the button "Buy now / Order with obligation to pay", you place a binding order for the goods contained in the shopping cart. The purchase contract is concluded with the order confirmation sent by email.
4. Prices and Taxes
All prices stated in the online shop are generally net, i.e., without statutory value-added tax.
The applicable value-added tax will – if legally required – be calculated and displayed only in the checkout according to the delivery country and customer status (private customer or business).

For recurring business customers, a payment term of up to 30 days may be granted after individual review. There is no entitlement to this.
6. Delivery and Shipping
Delivery is made within the European Union.
Delivery times:

Romania: approx. 1–3 working days

Other EU countries: approx. 2–5 working days, if the goods are in stock
Shipping is done via UPS (EU-wide) and FanCourier or comparable domestic service providers.
Partial deliveries are permissible, provided this is reasonable for the customer.
7. Retention of Title
The goods remain the property of Gosner Trade SRL until full payment of the purchase price.
8. Warranty
For Consumers (B2C):
Statutory warranty rights apply.
For Businesses (B2B):
The warranty period is 12 months from delivery of the goods.
No warranty applies in case of:

normal tool wear

improper use
-
incorrect cutting data or incorrect application
9. Liability
We are liable without limitation for intent and gross negligence.
In cases of slight negligence, we are only liable for breaches of essential contractual obligations and limited to foreseeable, typical damage.
Liability for production losses, consequential damages, or lost profits is excluded to the extent permitted by law.
10. Cancellation and Returns
Consumers (B2C):
The statutory right of withdrawal applies in accordance with the separate cancellation policy.
Business Customers (B2B):
There is no statutory right of withdrawal.
Voluntary Returns for Business Customers:
Business customers may be allowed a voluntary return after individual review. There is no legal entitlement to this.
11. Applicable Law and Jurisdiction
The law of Gosner Trade SRL's country of domicile applies, excluding the UN Convention on Contracts for the International Sale of Goods.
For businesses, the exclusive place of jurisdiction is the domicile of Gosner Trade SRL.
12. Contract Language
The contract language is German. The contract text will not be permanently stored.
13. Final Provisions
Should individual provisions of these GTC be wholly or partially invalid, the validity of the remaining provisions shall remain unaffected.
